2025 Session Last amended: 1989 session

§ 336.2A-214 — Exclusion or Modification of Warranties

Plain-Language Summary

The implied warranties of merchantability and fitness can be excluded or modified. To exclude merchantability, the word 'merchantability' must be used (and it must be conspicuous in a writing). 'As is' or 'with all faults' language excludes all implied warranties. Warranties can also be limited by course of dealing, course of performance, or usage of trade.

Practical Notes
A lessor can exclude warranties using specific language like ‘as is’ or by naming the warranty being disclaimed. Read your lease carefully.
