§ 336.2A-216 — Third-party Beneficiaries of Express and Implied Warranties

Plain-Language Summary

A lessor's warranty, whether express or implied, reaches any person who may reasonably be expected to use, consume, or be affected by the leased goods and who is injured when the warranty is breached. This protection cannot itself be excluded, modified, or limited. However, any limit on the warranty that is effective against the lessee is also effective against that protected person.

Practical Notes
A person injured by leased goods may bring a warranty claim even if they are not the lessee, as long as they could reasonably be expected to use, consume, or be affected by the goods. Keep in mind that any warranty exclusions or limits that bind the lessee also bind that person.
