§ 115B.48 — Definitions

This section defines key terms used in the Dry Cleaner Environmental Response and Reimbursement Law. A 'dry cleaning facility' is any commercial dry cleaning business in Minnesota, but coin-operated laundries, military base facilities, uniform/linen services, prisons, and Superfund sites are excluded. 'Full-time equivalence' is calculated at 2,000 hours per year and determines which registration fee tier a facility must pay. 'Owner or operator' includes both current and past owners and operators of a dry cleaning facility.

Practical Notes
Dry cleaning business owners — including those who no longer operate — may be considered ‘owners or operators’ and subject to obligations under this law. The exclusions matter: coin-operated dry cleaners, prison laundries, and facilities on the federal Superfund national priorities list are not covered by this program. The full-time equivalence calculation, based on hours worked July 1 through June 30, determines the annual registration fee tier ($500, $1,000, or $1,500) owed under section 115B.49.
