2025 Session Last amended: 2023 session

§ 13.072 — Opinions by the Commissioner

Plain-Language Summary

Any person can ask the Commissioner of Administration for a written opinion about whether a government entity is following the Data Practices Act correctly. The Commissioner must respond within a set time and the opinion is public.

Practical Notes
If a government entity denies your data request or you believe they are not following the law, you can ask the Commissioner for a written opinion at no cost. This is often faster and cheaper than going to court. The opinion is not legally binding, but courts give it significant weight.
