§ 13.085 — Administrative Remedy

Plain-Language Summary

This section provides an administrative remedy when a government entity fails to comply with the Data Practices Act. A person can file a complaint with the Office of Administrative Hearings, which can order the entity to comply.

Practical Notes
If a government entity refuses to give you data you are entitled to, you can file a complaint with the Office of Administrative Hearings instead of going to court. This is a quicker and less expensive option. The administrative law judge can order the entity to release the data and may award you compensation.
