§ 13D.06 — Civil Fines; Forfeiture of Office; Other Remedies

Plain-Language Summary

This section sets the penalties for violating the Open Meeting Law. Officials who intentionally violate the law face a fine of up to $300 per violation. After three violations, an official must forfeit their position. Courts can also award attorney fees up to $13,000.

Practical Notes
If a government body holds a secret meeting or violates the Open Meeting Law, any person can bring a lawsuit. The offending official pays the fine personally – the government body cannot pay it for them. If an official is found to have intentionally violated the law three times, they lose their position for the rest of their term. The court must award attorney fees to you if the body already received a written opinion about the issue and ignored it.
