§ 14.65 — Stay of Decision; Stay of Other Appeals

Plain-Language Summary

Filing a petition for judicial review does not automatically stop the agency's decision from taking effect. However, the court or agency can grant a stay if enforcement would cause irreparable harm and the public interest would not be harmed.

Practical Notes
If you need the agency’s decision to be paused while you appeal, you must specifically ask for a stay. The court or agency can stay the decision, but you must show that enforcing it would cause irreparable harm. Filing the appeal alone does not stop enforcement.
