§ 144G.31 — Violations and Fines

Plain-Language Summary

Violations found during assisted living facility surveys are rated by both severity (level 1 through 5, from minimal impact to death) and scope (isolated, pattern, or widespread). Higher levels and broader scope result in larger fines. Level 5 violations causing serious injury or death can result in fines up to $10,000. Abuse and maltreatment violations have mandatory minimum fines.

Practical Notes
When the Department of Health issues a correction order against an assisted living facility, the fine depends on both how serious the violation was and how widespread it was. A Level 5 widespread violation — one that caused or was likely to cause death and affected many residents — carries the highest fines. You can look up a facility’s correction order history on the Department of Health’s website.
