§ 144G.20 — Enforcement

The Department of Health may suspend, revoke, restrict, impose conditions on, or refuse to renew an assisted living facility license if the facility violates the law, commits fraud, harms residents, blocks department access, interferes with investigators or ombudsman staff, or fails to pay fines. Violations by contractors count as violations by the facility. The department can also require immediate corrective action, appoint a temporary manager, or restrict admissions as enforcement tools.

Practical Notes
As a facility operator, you are responsible for the conduct of all contractors providing services in your facility — their violations are your violations. If the department imposes a conditional license or suspension, comply immediately with any required corrective actions. Residents and families who believe a facility is violating the law can report concerns to the Department of Health’s Office of Health Facility Complaints.
