§ 144G.57 — Planned Closures

Plain-Language Summary

When an assisted living facility plans to close voluntarily, it must submit a closure plan to the Department of Health before taking any steps to close. The plan must explain how residents will be notified and helped to relocate, and how the facility will maintain compliance during the closure process. The department must approve the plan before the facility can proceed. Residents must receive at least 60 days' notice before the closure date. Emergency closures follow a modified process.

Practical Notes
If your assisted living facility tells you it is closing, the facility must have an approved closure plan from the Department of Health and must give you at least 60 days’ notice. The facility is required to help each resident find appropriate new housing and services — it cannot simply shut down and leave residents without support. Contact the Ombudsman for Long-Term Care immediately if you learn a facility plans to close.
