§ 148E.245 — Investigative Powers and Procedures

Plain-Language Summary

This section gives the Board of Social Work broad investigative powers. The board can issue subpoenas to compel records and testimony, order physical or mental examinations of social workers if there is probable cause of a violation, and access health records related to an investigation without the licensee's consent. Investigation records are classified as confidential. Special procedures apply to cases involving sexual conduct with clients.

Practical Notes
A social worker ordered to submit to a mental or physical examination by the board must comply—refusing is treated as an admission of the violation specified in the order. Investigation data is confidential, but final orders are public. Cases involving alleged sexual contact with a client exclude evidence of the client’s past sexual conduct, similar to rape shield laws. Complaints must be resolved within one year in most cases.
