§ 214.10 — Complaint, Investigation, and Hearing

Plain-Language Summary

This section establishes how licensing boards handle complaints, investigations, and hearings. Complaints are forwarded to the attorney general's office for evaluation. Boards can issue subpoenas and compel testimony. Special rules apply for complaints involving sexual contact with patients and crimes against minors. Separate procedures exist for the Peace Officer Standards and Training Board.

Practical Notes
If you file a complaint against a licensed professional, it will be investigated by the attorney general’s designee. At least two board members must review a complaint before it can be dismissed. Licensed professionals convicted of certain crimes against vulnerable people face mandatory disciplinary proceedings. Boards have subpoena power to compel evidence and testimony.
