§ 148E.270 — Voluntary Actions

This section describes voluntary actions the board can use when formal discipline is not necessary. An agreement for corrective action is a written agreement where the social worker completes specific steps—such as additional training or supervision—and the complaint is dismissed upon completion. The board can also enter a stipulation to cease practice when a social worker is unable to practice safely. Both types of voluntary actions are public data, even though they are not formal discipline.

Practical Notes
Corrective action agreements are a less severe outcome than formal discipline and can be a good resolution in cases involving minor violations or mistakes. However, they are still public and visible to potential employers and insurance credentialing committees. The board cannot use a corrective action agreement in cases of sexual conduct with a client unless there is insufficient evidence for formal discipline.
