§ 148E.255 — Types of Actions

Plain-Language Summary

This section establishes the three types of actions the Board of Social Work can take: disciplinary actions, adversarial but nondisciplinary actions, and voluntary actions. Disciplinary actions address violations and may include license revocation or suspension. Adversarial nondisciplinary actions include cease-and-desist orders and injunctions. Voluntary actions are corrective agreements that address concerns without formal discipline. All actions taken by the board are public data.

Practical Notes
Not every board action is discipline. A corrective action agreement, for example, is public but does not count as formal discipline. Social workers facing board proceedings should understand which type of action is being pursued, as the rights and procedures differ. All final board actions become part of the public record and can be found on the board’s website by anyone who searches.
