§ 152.137 — Fentanyl- and Methamphetamine-related Crime; Children and Vulnerable Adults

Plain-Language Summary

Makes it a felony (up to five years in prison) to manufacture meth, store meth chemicals, or expose children or vulnerable adults to methamphetamine or fentanyl. Police can take children into protective custody if found near meth activity.

Practical Notes
If children or vulnerable adults are present where meth is being made or stored, or if a child is exposed to fentanyl, separate felony charges apply on top of any drug manufacturing charges. Child protection and adult protection agencies must be notified.
