§ 161.3208 — Construction Manager/general Contractor; Authority

The Commissioner of Transportation has the authority to use the Construction Manager/General Contractor (CMGC) method for highway projects instead of the traditional competitive bidding process. No more than three CMGC contracts may be awarded in any calendar year. The commissioner must notify legislative committees whenever this procurement method is chosen and explain the reason.

Practical Notes
The CMGC method can result in fewer change orders, lower costs, and faster completion of highway projects. The commissioner can use this approach when it offers advantages over traditional design-bid-build.
