§ 161.433 — Use of Highway Airspace and Subsurface

Plain-Language Summary

The state may lease or permit the use of the airspace above or the subsurface below a trunk highway right-of-way when the use does not impair highway safety. Leases may last up to 99 years and must be approved by federal agencies when required. The rent must be at least a fair market rate and all proceeds go into the trunk highway fund.

Practical Notes
This section enables transit stations, utility lines, pedestrian tunnels, and commercial developments to be built above or below highway rights-of-way. Vehicles may not access these leased spaces directly from the highway if doing so would violate federal law or disrupt traffic flow. Anyone seeking to use highway airspace or subsurface must negotiate a lease or permit with the commissioner and may need federal approval.
