§ 161.45 — Utility on Highway Right-of-way; Relocation

Utilities such as electric lines, phone lines, pipelines, sewers, and cable TV lines that cross or run along trunk highways must follow rules set by the Commissioner of Transportation. High voltage electric transmission lines may be placed along any trunk highway, including interstates, unless the commissioner determines it would endanger public safety or impair the highway. When a highway project forces a utility to relocate, the state may act as the utility's agent to handle the relocation work.

Practical Notes
Utilities seeking to place infrastructure along or across a trunk highway must obtain a permit from the commissioner, who has 60 days to decide on the request. High voltage transmission line developers have additional rights and coordination requirements, including a constructability report process and advance notice before relocation is required. If the state forces early relocation of a high voltage line ahead of schedule, it may be responsible for 75 percent of relocation costs.
