2025 Session Last amended: 2021 session

§ 161.44 — Relinquishment of Land No Longer Needed

Plain-Language Summary

When the state no longer needs land it acquired for trunk highway purposes, the commissioner must first offer it back to the original owner (or surviving spouse) at the current appraised market value. The offer must be made by certified mail, and the owner has 60 days to accept. If the original owner declines or cannot be found, the land may be offered to adjacent property owners or sold by public auction. All proceeds go into the trunk highway fund.

Practical Notes
Former landowners whose property was taken by the state for a highway that was never built (or whose land became surplus) have a legal right to buy it back at current appraised value. Landowners should watch for certified mail from the Department of Transportation and respond within the 60-day window. The commissioner must also check whether surplus land is suitable for bicycle or pedestrian facilities before selling it.
