§ 161.46 — Reimbursement of Utility

When a federally aided interstate highway project requires a utility to move its facilities, the state must reimburse the utility for the net relocation cost from the trunk highway fund. The state can also acquire land for the utility's new facility location if the utility cannot obtain it on its own. The commissioner may do the relocation work as part of the highway contract if the utility requests it, paying the contractor directly from the trunk highway fund.

Practical Notes
Utilities facing mandatory relocation for interstate highway projects should work closely with the Department of Transportation on cost estimates and reimbursement agreements. High voltage transmission lines receiving a route permit after July 1, 2024, are generally not eligible for relocation reimbursement under this section. For smaller relocations (under $100,000), the state and utility can agree on a lump-sum settlement rather than tracking actual costs.
