§ 16B.981 — Financial Review of Grant and Business Subsidy Recipients

Before awarding a grant of $50,000 or more, state agencies must review the potential grantee's finances and ability to do the work. Nonprofits must submit their most recent IRS Form 990, and businesses must provide tax returns and financial statements. The agency can refuse to award a grant if there is a substantial risk the grantee cannot perform.

Practical Notes
Grantees must certify that no principal has been convicted of a felony financial crime in the last ten years. If an agency denies a grant, the grantee gets 15 days to respond and can challenge the decision through a contested case proceeding within 30 days. Agencies cannot require Indian Tribes or bands to deny their sovereignty as a condition of receiving a grant.
