§ 176.191 — Dispute Between Two or More Employers or Insurers Regarding Liability

Plain-Language Summary

When two or more employers or insurers disagree about which one is responsible for paying a worker's benefits, the commissioner can order one of them to start paying while the dispute is sorted out. The one who pays gets reimbursed with 12% interest once responsibility is determined.

Practical Notes
When this applies: When an injured worker’s claim involves multiple employers or insurers who each deny they are the one responsible. Who this affects: Injured workers caught between employers or insurers who are pointing fingers at each other. Key points: The key protection is that the injured worker keeps getting paid while the employers or insurers fight over who is responsible. If your health insurer has been paying your medical bills and it turns out to be a workers’ comp case, the workers’ comp insurer must reimburse your health insurer. Employers and insurers can use binding arbitration to resolve disputes over how to split the cost.
