2025 Session Last amended: 2007 session

§ 177.28 — Power to Make Rules

Plain-Language Summary

The Commissioner of Labor and Industry has authority to adopt rules to carry out Minnesota's Fair Labor Standards Act and prevent its evasion. The commissioner must adopt rules on specific topics including outside sales, allowances for board and lodging, bonuses, part-time rates, and special pay. The commissioner may also set subminimum wage rates for workers with disabilities under permits.

Practical Notes
When this applies: When interpreting or applying Minnesota wage and hour rules beyond what the statutes directly address. Who this affects: All Minnesota employees and employers. Key points: Administrative rules adopted under this section have the force of law and fill in details that the statutes do not cover, such as how board and lodging credits are calculated and what counts as outside sales. Rules regarding workers with disabilities require that a disabled person performing work equal to that of a nondisabled person must be paid the same wage. All rules are subject to the Administrative Procedure Act (chapter 14).
