§ 181.970 — Employee Indemnification

Plain-Language Summary

Employers in Minnesota must defend and pay for (indemnify) their employees when the employee is sued for something they did as part of their job, as long as the employee was not acting intentionally wrong or in bad faith.

Practical Notes
When this applies: When a Minnesota employee is sued or fined for actions taken while performing their job duties. Who this affects: Private-sector employees in Minnesota. Key points: Your employer must cover civil damages, penalties, and fines if you were doing your job and did not act with intentional misconduct, willful neglect, or bad faith. This law does not apply to government employees (they are covered by other statutes), or to employees covered by a separate indemnification agreement or corporate indemnification laws.
