§ 204C.35 — Federal, State, and Judicial Races

Losing candidates in very close federal, state, or judicial races can get a free manual recount if the vote margin is small enough (less than one-quarter or one-half percent, depending on the office). Candidates in less close races can request a recount at their own expense. Special rules apply to presidential elector recounts, which must be completed within six days. Recounts only examine ballots and certified summary statements.

Practical Notes
If you lose a state or federal race by a very small margin, you may be entitled to a taxpayer-funded recount. The filing officer must notify you of this right. Deadlines are tight: requests must be filed by 5:00 p.m. on the second day after the canvass, or by the next day for presidential electors.
