§ 216I.06 — Applications; Major Review

This section describes the 'major review' process, the most thorough permitting path for large energy projects. The PUC must prepare a full environmental impact statement (EIS) for each project. A public hearing conducted by an administrative law judge must be held at least 15 days after the draft EIS is published. After the hearing and public comment period, the administrative law judge submits a report, and the PUC must make a final decision within 60 days of receiving the report and within one year of determining the application is complete.

Practical Notes
The major review process is lengthy and detailed, often taking close to the one-year deadline allowed by law. Any person — not just formal parties — may attend the public hearing and offer testimony. If the PUC misses its deadlines, an applicant or affected person can go to court to compel action. The PUC cannot consider whether a project is needed in the environmental review; that question is handled in a separate ‘certificate of need’ proceeding.
