§ 116D.04 — Environmental Impact Statements

Plain-Language Summary

This is the main section requiring Environmental Impact Statements (EIS) for major projects. State agencies must prepare an EIS for any project that may significantly affect the environment. The EIS process includes an environmental assessment worksheet (EAW) to decide if a full EIS is needed. The law sets rules for who prepares the EIS, what it must cover, and how the public can participate.

Practical Notes
Developers and project proposers often must prepare or pay for environmental review documents. The EIS process can add time and cost to major projects such as mines, power plants, highways, and large developments. Citizens and organizations can challenge agency decisions about whether an EIS is required or adequate. Failure to complete required environmental review can halt a project in court.
