§ 244.0513 — Conditional Release of Nonviolent Controlled Substance Offenders; Treatment

Plain-Language Summary

This law allows nonviolent drug offenders to be released from prison early if they complete substance use disorder treatment. To qualify, the offender must be serving time for a drug possession or sale crime, have a substance use disorder, have served a minimum amount of time, and have no recent violent crime convictions. The offender must agree to drug testing and monitoring after release.

Practical Notes
Eligible offenders must petition the commissioner and can only use this program once. The commissioner must notify the prosecutor and sentencing court, giving them a chance to comment. A release plan covering aftercare, treatment, employment, and housing must be in place before release is granted. The commissioner can deny release if the offender poses a danger to the public.
