§ 609.1095 — Increased Sentences for Certain Dangerous and Repeat Felony Offenders

Plain-Language Summary

Allows courts to impose longer sentences on dangerous repeat felony offenders. A person convicted of a third violent felony can receive a sentence up to the statutory maximum. Someone convicted of a sixth felony in a pattern of criminal conduct can also receive an increased sentence.

Practical Notes
For the third violent felony enhancement, the offender must have been at least 18 at the time of the offense and be found to be a danger to public safety. The mandatory minimum for a third violent felony is the presumptive guidelines sentence, which must be served in full without probation or early release.
