§ 244.09 — Minnesota Sentencing Guidelines Commission

Plain-Language Summary

This law creates the Minnesota Sentencing Guidelines Commission, an 11-member body that writes the rules judges use when sentencing people convicted of felonies. The commission includes judges, attorneys, a peace officer, a probation officer, a crime victim or advocate, a formerly convicted person, and other members. The guidelines set when prison is appropriate and how long sentences should be.

Practical Notes
The Sentencing Guidelines are advisory to district courts but judges must follow guideline procedures when sentencing. Public safety is the primary consideration. Any changes that reduce sentences or release inmates early must be submitted to the legislature by January 15 and take effect August 1 unless the legislature acts otherwise. The commission also reports annually on mandatory minimum sentences and sentencing adjustments.
