§ 609.11 — Minimum Sentences of Imprisonment

Plain-Language Summary

Establishes mandatory minimum prison sentences for crimes committed with dangerous weapons or firearms in Minnesota. A person convicted of certain crimes while using a dangerous weapon must serve at least one year and one day; with a firearm, at least three years. Repeat offenders face longer mandatory minimums.

Practical Notes
Mandatory minimums mean the judge cannot give a shorter sentence, even with good reasons. If a firearm is used during a qualifying crime (including assault, robbery, kidnapping, sexual assault, and drug offenses), the minimum sentence is three years; five years for a second offense. For certain offenses involving firearms and gangs, the minimum can be as high as ten years. These sentences are served consecutively, meaning they are added on top of the sentence for the underlying crime.
