§ 244.10 — Sentencing Hearing; Deviation From Guidelines

When someone is convicted of a felony, either side can request a sentencing hearing. If the judge gives a sentence that is different from what the Sentencing Guidelines recommend (called a 'departure'), the judge must explain the reasons in writing.
