§ 256B.042 — Third-party Liability

Gives the state a lien on any legal claims or insurance recoveries when it has paid for a Medical Assistance recipient's medical care after an injury. The state can recover what it paid from lawsuit settlements, judgments, or insurance payments, but the recipient must receive at least one-third of the net recovery.

Practical Notes
If you are on Medical Assistance and get injured in an accident, the state will pay for your medical care. But if you later get money from a lawsuit or insurance claim related to that injury, the state has the right to be paid back for the care it covered. You are guaranteed to keep at least one-third of what is left after attorney fees.
