2025 Session Last amended: 2011 session

§ 514.69 — File With County

Plain-Language Summary

Describes how hospitals and public assistance agencies perfect a lien for unpaid care costs. A hospital must file a verified statement with the county within ten days of patient discharge, then mail a copy to each party claimed to be liable for damages.

Practical Notes
This is a hospital lien statute, not a storage lien. Hospitals must act quickly – the verified statement must be filed within ten days after patient discharge. The statement must include patient name and address, hospital information, admission and discharge dates, amount claimed, and the names of all persons believed to be liable. A copy must also be sent by certified mail to all potentially liable parties within one day of filing. Public assistance agencies under sections 256.015 or 256B.042 follow a similar process.
