§ 256G.03 — Establishing Residence

This section explains how to establish residence in Minnesota for human services purposes. Anyone living in a Minnesota county is considered a state resident. There is no waiting period to become a resident, but you cannot gain residence while staying in an excluded-time facility. Domestic abuse victims who enter a shelter directly from another state can establish residency while in the shelter.

Practical Notes
You do not need to live in Minnesota for any set amount of time before you can apply for human services. However, if you are in a hospital, jail, or similar facility, you cannot use that time to establish residence in a new county. If you are a domestic abuse victim who came to Minnesota and went directly to a shelter, you can establish residency there.
