§ 260D.06 — Agency Report to Court and Court Review of Child in Voluntary Foster Care for Treatment Due to Disability

Plain-Language Summary

Within 165 days of a voluntary foster care placement, the agency must submit a detailed written report to the juvenile court so the court can review whether the arrangement is in the child's best interests. The report must include the reasons for placement, a copy of the out-of-home placement plan, notes from administrative reviews, and a treatment plan for the child's disability. The court then has ten days to review the report and issue findings, without a formal hearing unless one is requested.

Practical Notes
Parents, children age 12 or older, and foster parents all have the right to submit information to the court and to request an in-person hearing. If a child age 12 or older disagrees with where they are placed or what services they receive, that must be included in the agency’s report. If the court finds the voluntary arrangement is not in the child’s best interests, it can appoint a guardian ad litem and set a hearing.
