§ 268B.07 — Determination on Issues of Eligibility

This section explains how the commissioner decides whether an applicant is eligible for benefits. The commissioner must notify the employer and send a decision to the applicant within two weeks. If someone got benefits they should not have, the overpayment must be repaid. The commissioner can also change a decision before it becomes final.

Your employer will be notified when you apply for and receive benefits, including your name, benefit start date, weekly amount, and maximum duration. If you are found eligible, benefits are paid even if the employer appeals. If a decision is later changed and you were overpaid, you will need to repay those benefits.
