§ 325D.06 — Inapplicable Sales

The below-cost selling rules do not apply in certain situations, such as closing out a business, selling damaged goods, selling under a court order, or matching a competitor's legal prices in good faith.

Practical Notes
If you are going out of business, selling seasonal or perishable items, selling damaged goods, or simply matching a competitor’s price, the below-cost selling law will not penalize you as long as you notify the public when required.
