2025 Session Last amended: 1986 session

§ 336.2-316 — Exclusion or Modification of Warranties

Plain-Language Summary

Sellers can limit or exclude warranties, but must follow specific rules. To disclaim the implied warranty of merchantability, the seller must use that word and make it conspicuous. Selling goods 'as is' excludes all implied warranties.

Practical Notes
Watch for ‘as is’ language when buying used goods, cars, or items at garage sales – it eliminates implied warranties. However, a seller cannot easily disclaim express warranties they already made. If a warranty disclaimer is buried in fine print and not conspicuous, it may not be enforceable.
