§ 336.3-309 — Enforcement of Lost, Destroyed, or Stolen Instrument

Plain-Language Summary

A person who loses an instrument or has it stolen can still enforce it by proving they were entitled to enforce it when the loss occurred, and that they cannot reasonably obtain the instrument. The court may require security to protect the payor.

Practical Notes
If you lose a check or it is stolen, you can still collect, but you may need to provide a bond to protect the bank.
