§ 336.3-404 — Impostors; Fictitious Payees

Plain-Language Summary

If an impostor tricks someone into issuing an instrument, or a dishonest employee creates a fictitious payee, the endorsement is effective and the loss falls on the person who was tricked, not on later good-faith takers.

Practical Notes
If a con artist tricks you into writing a check to a fake person, the loss falls on you, not on the bank that cashes the check.
