§ 394.27 — Creation and Duties of Board of Adjustment

Plain-Language Summary

This section requires counties to create a board of adjustment when they adopt zoning controls. The board has 3 to 7 members and handles variances and appeals from zoning decisions. It must include at least one member from unincorporated areas and one member from the planning commission.

Practical Notes
No elected county officials or county employees can serve on the board of adjustment. The board can issue variances, hear appeals from zoning administrators, and issue building permits in areas designated for future public use. When a decision affects land in a town, the board must consider the town board’s recommendation.
