2025 Session Last amended: 1987 session

§ 447.38 — Dissolution: Detachment of Territory

Plain-Language Summary

This section explains how to dissolve a hospital district or remove a city or town from it. Dissolution requires a petition, a finding that the district's purpose no longer exists, and that all debts are paid and property disposed of. A city or town can also detach from the district following a similar process.

Practical Notes
Dissolving a hospital district requires paying off all debt first, which can be a major hurdle. Any remaining funds after dissolution are divided among the member governments. Even after detachment, property in the detached area may still be taxed for existing bonds. This section provides an orderly exit when a district is no longer needed.
