§ 484.014 — Housing Records; Expungement of Eviction Information

Plain-Language Summary

This section sets rules for removing eviction records from public court databases in Minnesota, a process called expungement. In some situations expungement is automatic, such as when a case is dismissed, the tenant wins, or three years pass after an eviction order. In other situations a tenant must file a motion and ask the court to order expungement.

Practical Notes
An eviction record in a court database can make it nearly impossible to rent housing. Under this law, tenants who won their eviction case, had it dismissed, or reached a settlement they fulfilled can ask the court to remove the record from public view. Evictions based solely on marijuana possession may also be expunged. Expungement removes the court file from public access but does not erase it entirely.
