§ 609A.055 — Automatic Expungement of Certain Cannabis Offenses

Plain-Language Summary

This section creates an automatic expungement process for certain cannabis-related offenses that were legalized or reduced after Minnesota's 2023 cannabis law changes. The Bureau of Criminal Apprehension identifies qualifying records and automatically seals them without requiring the person to file a petition. The expungement applies to convictions, stays, dismissed charges, and arrests for small-amount cannabis offenses that are no longer crimes or are now lesser offenses.

Practical Notes
People with qualifying cannabis convictions or arrests do not need to do anything to receive this expungement — the state does it automatically. However, noncitizens should be aware that immigration authorities may have different rules about sealed records, and the BCA’s website must provide information on how noncitizens can obtain copies for immigration purposes. After expungement, the records should not appear on standard background checks, though the records are not destroyed and may still be accessible in very limited circumstances.
