§ 580.021 — Foreclosure Prevention Counseling

Plain-Language Summary

This section requires lenders to offer free foreclosure prevention counseling before starting a foreclosure on a home with one to four units where the owner lives. The lender must send the homeowner's contact information to an approved counseling agency so the agency can reach out and help.

Practical Notes
If you are facing foreclosure on your home, the lender must tell you about free counseling services before the foreclosure process begins. These counseling agencies are nonprofits approved by the Minnesota Housing Finance Agency or HUD. The lender does not have to agree to any deal, but must provide a contact person who can discuss your mortgage and negotiate options.
