§ 609.2335 — Financial Exploitation of Vulnerable Adult

Plain-Language Summary

It is a crime to financially exploit a vulnerable adult. This includes misusing their money or property while in a position of trust, taking their assets through manipulation or force, or forcing them to work for someone else's profit. Penalties depend on the amount taken and can be as serious as those for theft.

Practical Notes
This law protects vulnerable adults from people who abuse their trust to steal money or property. Even family members with power of attorney can be charged if they misuse a vulnerable adult’s funds. The prosecution can add up amounts taken over six months to increase the charges. Cases can be tried where the crime happened or where the victim lives.
