§ 609.52 — Theft

Plain-Language Summary

Minnesota's comprehensive theft statute. Covers taking property without consent, swindling, embezzlement, receiving stolen property, theft of services, motor fuel theft, identity theft-related theft, and wage theft. Penalties range from a misdemeanor (property under $500) to a felony carrying up to 20 years for theft over $35,000 or certain aggravating circumstances.

Practical Notes
Theft penalties in Minnesota depend primarily on the value of the property stolen: under $500 is a misdemeanor (up to 90 days); $500-$1,000 is a gross misdemeanor (up to 364 days); over $1,000 is a felony (up to 5 years); over $5,000 is a more serious felony (up to 10 years); and over $35,000 carries up to 20 years. Values from multiple thefts within a 6-month period can be combined to reach higher penalty thresholds. Prior theft convictions also enhance penalties. Shoplifting, employee theft, failure to return rental property, and wage theft all fall under this statute. A theft conviction can make it very difficult to find employment. Consider consulting a defense attorney, and explore expungement options for past convictions.
