§ 609.234 — Failure to Report

Plain-Language Summary

People who are required by law to report suspected abuse of vulnerable adults commit a crime if they intentionally fail to report, provide false information, or leave out important facts. Basic failure to report is a misdemeanor. It becomes a gross misdemeanor if the person knew the abuse caused death or great bodily harm and the failure to report contributes to further harm.

Practical Notes
Mandated reporters include health care workers, social workers, law enforcement, and others in professional roles. If you are a mandated reporter and suspect a vulnerable adult is being maltreated, you must report it promptly. Failing to do so can result in criminal charges, especially if the vulnerable adult suffers serious injury or death as a result.
