2025 Session Last amended: 2023 session

§ 609.247 — Carjacking

Plain-Language Summary

Carjacking means taking a motor vehicle from someone by using or threatening force. First-degree carjacking (armed or causing injury) carries up to 20 years in prison. Second-degree (implying a weapon) carries up to 15 years. Third-degree (all other cases) carries up to 10 years.

Practical Notes
Minnesota created this specific carjacking law in 2023 to address the growing problem of vehicle theft by force. Previously, carjacking was prosecuted under general robbery statutes. The penalties are the same as for aggravated robbery and simple robbery. This law applies to any motor vehicle, including cars, trucks, and motorcycles.
